Shari’a Legitimacy for Hajj on behalf of others

Hajj is the 5th pillar of Islam, an act of physical worshipping like praying or fasting, and it’s visiting the sanctified house of Allah in order to perform specific acts of worship that consist of Ihram, Tawaf, going between Al Safa and Al Marwa, standing at Arafa, throwing Al Jamrat, and staying in Mena.

Hajj is a requirement for those who are able. As for those who are deceased before they can complete it, someone should do it on their behalf, and the burden of delegating such act falls in the shoulders of his next of kin. And the same goes for the sick and unable.

Ibn Abbas narrated that a woman came to the prophet (PbUH) asking him If she should perform Hajj on behalf of her sick father, of which he answered with cconfirmation.

Narrated by Al Bukhari

Ibn Abbas narrated that a woman came to prophet Mohammad (PbUH) stating that her mothervowed to Allah that she would undertake Hajj, but she passed away without doing it, and asked if she (the woman) could do it instead of her mother. The prophet (PbUH) told her that she could, just asif her mother had debts she would pay them off. Finally, he stated that we should fulfill Allah’s vows, for he is the most deserved of fulfilling.

Conditions for Hajj on behalf

First: The person doing Hajj on  behalf of someone else must have completed the Hajj right themselves first.

Second: Delegation must be on behalf of someone who is unable through incurable sickness or old age, and the deceased.

Third: The delegate must be able to perform all rites of Hajj by themselves.

Fourth: The delegate must be an honest and trusted person.

Fifth: A male can perform Hajj on behalf of both a male and a female, as can a female do the same.

 

Delegating in Hajj on behalf

Hajj can be delegated in two cases:

First: If a person dies without performing Hajj, then his next of kin must delegate someone to perform it on their behalf. It is also allowed for someone to volunteer.

Second: If a Muslim is ill with an incurable sickness, or too old to travel, then delegating his Hajj is a must, even If pain for it.
